The new regime is due to come into force Autumn 2022. It will consist primarily of the provisions in the subsidy control chapters of the Trade & Co-Operation Agreement with the EU, the Subsidy Control Act 2022, Regulations and Guidance from BEIS and the CMA. BEIS is currently consulting on Guidance under Section 79 of the Act.
The Regulations are expected to set out the definitions of categories for Subsidies or Schemes of Interest or Particular Interest, to specify the information to be included in a public authority’s entry in the subsidy database, to set out a methodology for public authorities to follow when calculating the gross cash equivalent of subsidies, and to specify modifications to the CMA’s information gathering powers.
